Notice of Initiation of Investigation and Interim Measures in EAPA Case 7907 – Mobile Access Equipment from China
WASHINGTON—On October 1, 2024, U.S. Customs and Border Protection (CBP) issued its Notice of Initiation of Investigation and Interim Measures as to evasion by Sinoboom North America, LLC (Sinoboom NA) in Enforce and Protect Act (EAPA) Investigation 7907. This investigation is examining the evasion of antidumping (AD) and countervailing (CVD) duty orders A-570-139 and C-570-140 on mobile access equipment (MAE) from the People’s Republic of China (China). CBP found there was a reasonable suspicion that Sinoboom NA entered Chinese-origin MAE for consumption into the customs territory of the United States through evasion by claiming Poland as the country of origin for the merchandise.
In light of CBP’s determination that Sinoboom NA entered MAE into the customs territory of the United States through evasion, and pursuant to its authorities under EAPA, CBP will:
- Require “live” entry for all imports of certain chassis and subassemblies thereof, meaning the importer must submit proper import documentation and duties prior to the release of its merchandise;
- Extend liquidation of unliquidated entries entered before the date of initiation (June 26, 2024);
- Suspend liquidation of unliquidated entries entered on or after the date of initiation (June 26, 2024);
- Reject any entry summaries and require a re-file for those entries that are within the entry summary reject period;
- Require “live” entry for imports of MAE from Poland and require Sinoboom NA to submit proper documentation and all duties before release of MAE; and
- The duty rates are the “China-Wide Entity” for A-570-139 and C-570-140, if the Department of Commerce has not determined a separate rate that would apply to that entry.
These actions do not preclude CBP from taking additional enforcement measures as it determines appropriate under its EAPA or other legal authorities, which include pursuing civil penalties or investigations into criminal violations.
