Notification of Initiation and Interim Measures in EAPA Case 7913 – Mattresses from China, Vietnam, and Indonesia 

WASHINGTON—On October 30, 2024, U.S. Customs and Border Protection (CBP) issued its notification of initiation of investigation of alleged evasion by Alexand Inc., Alloech Inc., Anlowo, Inc., Bentensh Import Inc., Calimoon Inc., Day Day Up Inc., Deluxe Home of USA Inc., Gemmeo Inc., Haiide Inc., Hondex Inc., Incoroy Inc., Inland Empire Decor Furnishing Inc., Lincody Inc., Lirachy, Inc., Newland Technology Inc., Outlier Inc., Splendid Life Distribute Inc., Startown Inc., Sunshine International Inc., Vovyace Inc., Weekaly Inc., Wuleitex Inc., and Zozonid Inc. (the Importers) in Enforce and Protect Act (EAPA) consolidated investigation 7913. Specifically, CBP is investigating whether the Importers evaded AD order A-570-092 and CVD order C-570-128 on mattresses from China, and/or the AD order on mattresses from Vietnam (A–552–827) and/or the AD order on mattresses from Indonesia (A-560-836) with their entries of merchandise into the United States. Because evidence establishes a reasonable suspicion that the Importers entered merchandise into the United States through evasion, CBP has taken the following interim measures: 

  • Require “live” entry for all imports of mattresses, meaning the Importers must submit proper import documentation and duties prior to the release of its merchandise;
  • Suspend or extend liquidation of the Importers’ entries of mattresses without final computation or determination of duties (liquidation), as appropriate;
  • Review the Importers’ continuous bonds and application of single transaction bonds for their entries, as appropriate.

These actions do not preclude CBP from taking additional enforcement measures as it determines appropriate under its EAPA or other legal authorities, which include pursuing civil penalties or investigations into criminal violations.
