On Aug. 11, Mr. Gutierrez arrived at the Hidalgo-Reynosa International Bridge pedestrian walkway and presented his U.S. passport to the CBP officer. A primary check revealed that he was a possible match to an arrest warrant therefore, officers escorted him to secondary for verification. Biometric verification through CBP and law enforcement databases confirmed Gutierrez’s identity along with the active felony rape warrant from the Gainesville, Georgia Sheriff’s Office.

The warrant was issued in July 2020 for an alleged incident that occurred in Aug. 2019 while Gutierrez resided in Gainesville.

CBP OFO arrested Gutierrez and the Hidalgo County Sheriff’s Office transported him to the Hidalgo County jail where he will await extradition procedures.

Criminal charges are merely allegations. Defendants are presumed innocent unless proven guilty in a court of law.
