EAPA Case 7430: Carbon Activated Corp. (Notice of Determination as to Evasion, February 23, 2021)

WASHINGTON—On February 23, U.S. Customs and Border Protection (CBP) issued its determination as to evasion by Carbon Activated Corp (“CAC”) in its Enforce and Protect Act (EAPA) investigation, EAPA Case 7430, into the evasion of antidumping and countervailing duty (AD/CVD) orders for activated carbon from the People’s Republic of China (China). CBP found there was not substantial evidence that CAC had been entering subject merchandise from China that had been transshipped through Indonesia.

This determination does not preclude CBP from taking additional enforcement measures as it determines appropriate under its EAPA or other legal authorities, which include pursuing civil penalties or investigations into criminal violations.
