EAPA Cons. Case 7888: Various Importers (Notice of Initiation of Investigation and Interim Measures, June 17, 2024)

EAPA Action: Notification of Initiation of Investigation and Interim Measures for EAPA Consolidated Case 7888 - Quartz Surface Products from China 

WASHINGTON—On June 17, 2024, U.S. Customs and Border Protection (CBP) issued its notification of initiation of investigation and interim measures as to evasion by US Atlanta International Inc., Global Source & Supply, Inc., Cosmos Granite (East) Marble, and Cosmos Granite (West), LLC. in Enforce and Protect Act (EAPA) investigation cons. 7888. This investigation is examining the evasion of antidumping (AD) and countervailing (CVD) duty orders A-570-084 and C-570-085 on quartz surface products from the People’s Republic of China (China). CBP found there was a reasonable suspicion that US Atlanta International Inc., Global Source & Supply, Inc., Cosmos Granite (East) Marble, and Cosmos Granite (West), LLC. had been entering quartz surface products from China by transshipment. 

In light of CBP’s determination that US Atlanta International Inc., Global Source & Supply, Inc., Cosmos Granite (East) Marble, and Cosmos Granite (West), LLC. entered quartz surface products into the customs territory of the United States through evasion, and pursuant to its authorities under EAPA, CBP will: 

  • For Cosmos East and US Atlanta, extend liquidation of unliquidated entries entered before the date of initiation (March 11, 2024); 
  • For all 4 importers, suspend liquidation of unliquidated entries entered on or after the date of initiation (March 11, 2024); 
  • For all 4 importers, reject any entry summaries and require a re-file for those entries that are within the entry summary reject period; 
  • For all 4 importers, require “live” entry for imports of QSP from Thailand and require US Atlanta, Global Source, Cosmos East, and Cosmos West to submit proper documentation and all duties before release of QSP; 
  • For all 4 importers, the duty rates are the “China-Wide Entity” for A-570-084-000 and C-570-085-000, if the Department of Commerce has not determined a separate rate that would apply to that entry. 

These actions do not preclude CBP from taking additional enforcement measures as it determines appropriate under its EAPA or other legal authorities, which include pursuing civil penalties or investigations into criminal violations.
