EAPA investigation 7250: Lyke Industrial Tool, LLC (Notice of Determination as to Evasion, August 10, 2021)

EAPA Action: Determination as to Evasion in EAPA Case 7250 - Diamond Sawblades

WASHINGTON—On August 10, U.S. Customs and Border Protection (“CBP”) issued its determination as to evasion against Lyke Industrial Tool, LLC (“Lyke”) in its Enforce and Protect Act (“EAPA”) investigation 7250 into the evasion of an antidumping duty (“AD”) order for diamond sawblades from the People’s Republic of China (“China”). EAPA found that substantial evidence exists that Lyke evaded antidumping duty order A-570-900 by transshipping diamond sawblades from China through Thailand. As a result, Lyke evaded a significant amount of antidumping duties owed to the U.S. Government.

In light of CBP’s determination that Lyke entered covered merchandise into the customs territory of the United States through evasion, and pursuant to its authorities under EAPA, CBP will:

  • Suspend or continue to suspend Lyke’s entries subject to this investigation until instructed to liquidate the entries;
  • Change any previously extended non-AD/CVD entries to AD/CVD entries and adjust rates to reflect that change, as well as continue suspension until instructed to calculate the total money owed to CPB on these entries based on current duty rates and the imported goods’ value ; and
  • Review Lyke’s continuous bonds and may require single transaction bonds, as appropriate.

These actions do not preclude CBP from taking additional enforcement measures as it determines appropriate under its EAPA or other legal authorities, which include pursuing civil penalties or investigations into criminal violations.
