QUOTA PERIOD:

OPENING DATE:

Monday, October 3, 2022 at 12:00 PM Eastern Time (ET) for all time zones.

THIS QUOTA IS EXPECTED TO OVERSUBSCRIBE AT OPENING MOMENT

To identify all Refined Sugars and Specialty Sugar Periods, unique 9903 Harmonized Tariff Schedule Numbers (HTS) have been created and combined to the current tariff numbers.  Please report as indicated below: (If entry summaries are misclassified, they will not be included in the opening).

The Trade may transmit the quota entry summaries in ACE on October 3, 2022 from 12:00 AM (midnight) local port time until 12:00 PM (noon) Eastern Time (ET) only.  Please immediately report transmission problems to the ACE Client Representative and HQ Quota and Agriculture Branch (QAB).  Notification delays may result in exclusion from the opening. 

* If entry summaries are reported early or late (after 12 Noon ET or before 12 Midnight (Local Time), they will not be processed for the opening; however, early transmissions may be retransmitted within the proper range of time.  Filers experiencing transmission problems should contact the ABI client representative and immediately notify the HQ Quota and Agriculture Branch.  Entry summaries with transmission issues submitted late will be reviewed and handled by QAB on a case by case basis.

SPECIAL INSTRUCTIONS:

Please ensure that warehouse entry summaries associated with the warehouse withdrawals are not finalized and the collections for the warehouse withdrawals are only submitted with collection code 002.  A final collection code 092 with a zero duty amount may be processed on the warehouse entry by CBP, once the final warehouse ledger information is submitted to close out the warehouse entry summary.

To ensure reporting accuracy prior to establishing the Prorata Percentage, associated entries are held 72 hours.  Once the percentage is calculated for ACE filed entries will receive a UC message indicating the reserved or prorated quantity per reported quota line.

Since ACE Deployment, over quota duty rates are no longer reported in the quota module and should be entered as a 01 entry type.

SPECIAL INSTRUCTIONS:

Please refer to chapter 99, subchapter IV, U.S. note 1 for the list of countries that are not subject to additional agricultural safeguard duties under heading 9904.  Imports from these countries should be presented as a 01entry type using the high rate (over-quota) tariff number provided for in chapters 17 or 21, without the Chapter 99 HTS number.  Non-ABI entry summary must be updated in ACE prior to processing collections.
